These Terms of Service ("Terms") govern your access to and use of the CertusFX application (the "Service") operated by NestCalc.ai LLC dba CertusFX ("CertusFX," "we," "us," or "our"), a Wyoming limited liability company. Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By accessing or using the Service, creating an account, or purchasing a Pro pass, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
2. Description of Service
CertusFX is a currency-intelligence app. The Service provides a currency converter, exchange-rate market boards, government bond-yield dashboards, and AI trend outlooks to help users follow foreign-exchange markets.
The Service is offered in two plans:

Free — the core app: the converter, boards for the major currencies, 30-day charts, a personal watchlist, and daily ECB reference rates.
•
Pro Passes — one-time purchases granting Pro access for a fixed period. Pro unlocks 160+ currencies, keyed data rails, the bond-yield dashboard, AI trend outlooks, rate alerts, unlimited watchlists, and CSV export.
Every Pro purchase is a one-time pass for a fixed term. Nothing recurs, nothing continues on its own, and nothing is charged again unless you choose to buy another pass.
Current pricing is displayed in the app and on your app store listing at the time of purchase, and may vary by region and currency. Features, pricing, and plan inclusions are subject to change. We will provide reasonable notice of material changes as described in Section 13.
3. Account Registration
The core app works without an account. To purchase a Pro pass or have your plan recognized across devices, you must create an account using a valid email address. You agree to:

Provide accurate, current, and complete information during registration
•
Maintain and promptly update your account information to keep it accurate
•
Maintain the security of your password and accept responsibility for all activity under your account
•
Notify us immediately of any unauthorized use of your account
•
Create and maintain only one account per person
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
4. Purchases & Payment Terms
In-app purchases are processed by the app store you buy through — the Apple App Store or Google Play — under the applicable store terms. By purchasing a Pro pass, you agree to the following:

One-time purchases: Every pass is a one-time purchase for a fixed term. There is no recurring billing — your pass ends when its term is up unless you choose to buy another.
•
Stacking: If you buy a pass while another pass is still active, the new term is added to your remaining time — you never lose time you have paid for.
•
Price Changes: We will provide at least 30 days' notice before any price increases take effect. Price changes apply only to future purchases, never to a pass you already hold.
•
There is nothing to buy on the web version of the Service.
5. Refund Policy
Refunds for passes purchased in the app are governed by the policies of the app store you purchased through (Apple App Store or Google Play) and must be requested through that store. If the store refunds a pass, the corresponding Pro access is revoked at the time of the refund.
How to Request a Refund
To request a refund for an in-app purchase, use the refund process of the app store you purchased from (Apple App Store or Google Play). If you need help, contact us at support@nestcalc.ai with your account email and a brief description of the issue.
6. AI-Generated Content Disclaimer
The Service shows AI trend outlooks: a deterministic signal (direction, strength, confidence) computed from public market data — exchange-rate history and government bond-yield differentials — with short prose written by an AI model (Anthropic Claude) that explains the computed signal.
You acknowledge and agree that:

AI trend outlooks are estimates and opinions, not guarantees of accuracy, completeness, or timeliness.
•
AI-written text may be inaccurate, incomplete, or outdated. AI models may "hallucinate" — generating plausible-sounding but factually incorrect statements.
•
You are solely responsible for independently verifying all data and outlooks before relying on them for any purpose.
•
CertusFX is NOT a financial advisor, broker, dealer, or licensed professional of any kind. The Service does not provide financial, legal, tax, or investment advice.
•
AI outputs do not constitute a recommendation to buy, sell, hold, or exchange any currency or financial instrument.
7. Financial Disclaimer
All rates, yields, charts, and outlooks provided by the Service are informational reference values. They are not dealing quotes, not a price at which you can transact, and do not reflect the actual rate you will receive from any bank, payment provider, or exchange service.

Data can be delayed, approximate, or wrong, and coverage can change without notice.
•
Past performance does not guarantee future results. Historical trends referenced by the Service may not continue.
•
Foreign-exchange markets involve significant risk. Exchange rates can move substantially and without warning.
•
You should confirm the actual rate with your bank, payment provider, or exchange service, and consult licensed professionals, before moving money or making any financial decision.
•
CertusFX assumes no liability for any financial decisions you make or any outcomes that result from your use of the Service.
By using the Service, you acknowledge that you assume all risk associated with your financial decisions and that CertusFX bears no responsibility for those outcomes.
8. Intellectual Property
The Service, including its design, code, algorithms, text, graphics, logos, and all other content created by CertusFX (collectively, "Platform Content"), is the exclusive property of NestCalc.ai LLC dba CertusFX and is protected by applicable intellectual property laws.
You retain all rights to the data you input into the Service (watchlists, alerts, preferences). We do not claim ownership of your input data. However, you grant us a limited license to process your data solely for the purpose of providing the Service.
9. Acceptable Use
You agree not to:

Scrape, crawl, or use automated tools to extract data from the Service
•
Reverse engineer, decompile, or disassemble any part of the Service
•
Access or attempt to access the Service's APIs, servers, or databases through unauthorized means
•
Resell, sublicense, or redistribute data, charts, or outlooks obtained from the Service
•
Use the Service to develop a competing product or service
•
Interfere with or disrupt the Service, its servers, or connected networks
•
Impersonate another person or misrepresent your affiliation with any entity
•
Use the Service for any unlawful purpose or in violation of any applicable laws
Violation of these terms may result in immediate account termination without refund.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

CertusFX's total aggregate liability to you for all claims arising out of or related to the Service shall not exceed the total amount you paid to CertusFX in the 12 months immediately preceding the event giving rise to the claim.

IN NO EVENT SHALL CERTUSFX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, loss of data, or loss of business opportunities, regardless of the theory of liability.
•
This limitation applies even if CertusFX has been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
11. Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration, not in court. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) and shall take place in Wyoming or remotely, at the election of the claimant.
Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive the right to participate in a class action lawsuit or class-wide arbitration against CertusFX.
Individual Claims Only
All claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Exceptions
Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
12. Termination
By CertusFX: We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
By You: You may stop using the Service at any time. Passes are one-time purchases — there is nothing to cancel; a pass simply lapses at the end of its term. You may delete your account as described on our Delete data page or by contacting support@nestcalc.ai.
Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 10, and 11 of these Terms survive termination.
13. Changes to Terms
We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice by updating the "Last Updated" date at the top of this page and, where appropriate, notifying you via email or an in-app notice.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
